Denver DUID Attorney
Charged with DUID?
If you are accused of DUID, you need a criminal defense lawyer to get into action for you immediately. The authorities come down heavily on those who are driving under the influence of drugs, and a conviction can have very heavy consequences. A DUID carries the same penalties as driving under the influence of alcohol, but there are defense options that could be effective and help you to avoid conviction. We at, M. Trent Trani & Associates, P.C. are highly skilled trial lawyers, with an extensive record of successful defense cases, including in cases of DUID charges. Our team has over 20 years of experience and we are ready to help you fight back.
The penalties for a 1st offense DUID are 5 days to 1 year in jail, a fine up to $1,000, a license suspension for up to 9 months, and community service for up to 96 hours. Attending an alcohol treatment program can replace the jail sentence for a 1st offense DUID. For a 2nd offense DUID the penalties are 10 days to 1 year in jail, a fine up to $1,500, a maximum 120 hours of community service, and a 2 year probation period. A third DUID is extremely dangerous, with penalties of 60 days to 1 year, a fine of up to $1,500, community service for a maximum of 120 hours, mandatory attendance of a drug and alcohol driving and safety educational or treatment program, and a 2 years of probation.
Fighting a DUID Charge in Denver
You can be arrested and charged with DUID for driving while impaired by prescription medicine, over-the-counter medication, marijuana, cocaine, or any other controlled substance, whether legally prescribed or illegal recreational drugs. As establishing drug intoxication may be difficult, and the testing for controlled substances in urine or blood is far less accurate than alcohol testing, there may be the possibility of getting your case dismissed early.
It is imperative that we review the evidence without delay. Drug tests could have occurred too long after your arrest and may not adequately prove you were driving under the influence of drugs or were impaired by drugs at the time you were operating your vehicle. The testing process may have been flawed, or you could be the victim of an illegal police stop.
